Requirement of Consent
Your use of FellowDoc.com services and products is governed by the software license and other terms and conditions. Your agreement to these terms is required to use the services and products. Before using the software, please read the applicable terms carefully.
I. Introductory Provisions
Basic concepts for the purposes of these Regulations:
- Portal Owner — the company: BX Maciej Bajer. Headquarters address: Literacka 15/23, 01-864 Warsaw, Poland. VAT EU: PL1182303355. Email: info@fellowdoc.com
- Portal — an IT system that includes a website available at https://fellowdoc.com
- User — a person using the Portal
- Account — an account created by the User within the Portal, enabling the use of certain functionalities of the Portal
- Offer — announcement published on the Portal
Using the Portal requires accepting these Regulations and the Privacy Policy. Accepting the Regulations is tantamount to a declaration of knowledge, understanding and commitment to comply with their provisions.
The Regulations are consistent with the applicable provisions of Polish and European Union law, including in particular the Civil Code, the Act on the provision of services by electronic means, the Act on consumer rights, and Regulation (EU) 2016/679 (GDPR).
II. Using the Portal
- The Portal enables Users who do not have an Account to:
- browse published advertisements available on the Portal
- The Portal enables Users who have an Account to:
- browse published offers available on the Portal
- create and edit offers on the Portal
- paid publication of offers for a specified period of time in accordance with the current price list depending on the offer parameters
- Data provided during registration and other personal data that may be collected from Users when using the Portal are collected and used in accordance with the Privacy Policy.
- To publish ads, it is necessary to create an Account. By creating an account, the User agrees to provide true information and fully accepts the Terms of Use of the Portal.
- The User must keep their password secret and is responsible for all consequences caused by their own and unauthorized access to the Portal by persons to whom they have provided login and password.
- The User may not use the Portal in a manner that is illegal, contrary to good customs, violates the Regulations, or may expose the Portal Owner or third parties to damages.
- No special technical requirements are necessary to use the Portal—Internet access, an email address, and a standard operating system and web browser are sufficient.
- Users' personal data are processed in accordance with applicable law and the Privacy Policy.
- Services are provided in Poland.
III. Responsibility for Content
- Users may create or upload content when using the Portal.
- Users are solely responsible for content and any damage resulting from the content they publish, transmit, link, or otherwise make available via the Portal.
- The Portal Owner is not responsible for content posted by Users.
IV. Content Ownership
- Any content uploaded to the Portal becomes the property of the Portal Owner indefinitely.
- Users grant the Portal Owner the right to store, archive, analyze, process, modify, share, and display content. Licenses granted to the Portal Owner are indefinite.
- Users understand they will not receive payment for any rights granted to the Portal Owner.
- The Portal Owner may block or remove any content at its sole discretion if it violates laws, conditions, or rules.
V. Rights and Obligations
- The Portal Owner provides services and products “as is,” without any warranty.
- The Portal Owner expressly disclaims all warranties, including merchantability, fitness for a particular purpose, title, security, accuracy, and non-infringement.
- The Portal Owner does not guarantee that the Portal will meet User requirements, operate uninterrupted, timely, securely, error-free, or that information is accurate. Defects or errors may not be corrected.
- The Portal Owner does not guarantee service continuity due to reasons beyond its control.
- The Portal Owner may temporarily suspend the Service or limit access for maintenance, modernization, or security.
- The Portal Owner is not liable for damages caused by improper use, false or incomplete data, or force majeure.
- The Portal Owner may block or delete Accounts and cease services if Users act inconsistently with the law or Regulations.
VI. Conclusion of a Purchase Agreement
- Customers conclude distance purchase agreements with the Portal Owner via the online store.
- Placing an order on the website constitutes an offer by the customer.
- To place an order, click "Order and pay" or similar.
- Products and Services may be purchased by legal entities worldwide and individuals residing in Poland.
- Consumers have the right to withdraw from the agreement within 14 days. Refunds before service commencement are made within 14 days; no refunds after service commencement due to the personalized nature of the service.
- Offer publication is ordered for a specified number of calendar days, selected by the User.
- Offer promotion is ordered for a specified number of calendar days, selected by the User.
- User account subscriptions are ordered for a specified number of calendar days, selected by the User.
- Orders are processed automatically within an hour of payment confirmation.
VII. Returns
- Offer publication is temporary and personalized and is non-refundable.
- Offer promotion is temporary and personalized and is non-refundable.
- User account subscriptions are temporary and personalized and are non-refundable.
VIII. Complaints
- Users may file complaints regarding Portal functionality at info@fellowdoc.com
- Complaints must include User identification and a description of the objection.
- The Portal Owner will review complaints within 14 days and inform the User of the decision.
- Offer publication, promotion, and account subscriptions are not subject to complaint.
IX. Applicable Law and Disputes
- Polish law and relevant EU regulations apply to these Regulations and services.
- Disputes will be resolved by the competent court in the Portal Owner’s jurisdiction.
X. Final Provisions
- Matters not regulated by the Regulations follow Polish and EU law, including the Civil Code, the Act of 18 July 2002 on electronic services, and the Act of 19 August 2011 on payment services.
- If any provision is invalid or ineffective, it does not affect the validity of remaining provisions.
